— A state disciplinary board is recommending that a western Michigan district judge receive a 30-day suspension for sending a defense lawyer to jail for contempt of court.
The Michigan Judicial Tenure Commission made the recommendation after a Feb. 4 meeting in Detroit.
The commission says that Hudsonville District Judge Kenneth D. Post committed judicial misconduct on Dec. 2, 2011, when he jailed defense lawyer Scott Millard who objected to the judge questioning his client about whether he would test positive for drugs.
The judge's lawyer says the proposed punishment is too harsh.
Doug Van Essen says a reprimand is more appropriate than 30 days without pay.
The Michigan Supreme Court will decide whether to accept the recommendation.
